Q. What is the workers' compensation law?
A . The New York state workers' compensation law provides you with cash benefits (wage replacement), medical benefits and rehabilitation services if you are injured or become ill as result of your employment.
Q. What injuries and illnesses are covered by the workers' compensation law?
A . Workers' compensation provides wage replacement medical and other health provider care for all types of injuries, disabilities and illnesses ranging from ones which may last only a few weeks to a condition the may last the rest of your life.
Q. What do I need to do if I am injured at work?
A. If you are injured at work your first concern is to get prompt medical treatment for your injuries. Should you require emergency care you may got to any doctor or hospital for your initial emergency treatment. However, you must inform the attending doctor that your injury or illness was sustained at work and you will be filing a workers compensation claim for benefits. This is especially important because the doctor must fill out and file a medical report stating the nature and extent of your injuries. This form is called the attending doctor's report (C-4/C-48). After you receive emergency medical treatment and it is determined that you need further medical care, you should then use a New York state workers' compensation board certified doctor or provider. These doctors are certified by the compensation board to treat compensation cases. Of course, you are entitled to the doctor of your own choice but again, that doctor should be certified by the board. You can obtain a list of certified doctors/providers by calling the New York state workers compensation board at 1 (800) 877-1373.
